Terms of Service


1. General


For the business relationship between the coach (hereinafter: "coach") and the customer (hereinafter: "customer"), the following general terms and conditions apply exclusively in the version valid at the time the service is provided.

Customers within the meaning of Section 1 Clause 1 are private individuals, companies and state institutions.


2 Subject of the contract


The subject of the contract is individual advice and support for customers as part of the agreed training and health advice.


3 Subject of performance


The coach offers the customer a concept that is optimally tailored to the customer. The concept contains various recommendations for training content and techniques. The concept takes into account the respective needs and physical abilities of the customer.

The coach guarantees the customer individual advice. The customer is looked after personally by the coach.

The following services are also offered: Running style analysis.


4 Training and appointment scheduling


Before the start of the training sessions, there is a personal consultation with the customer. The contents and goals are coordinated in a discussion. During the consultation, the customer informs the coach about their health and physical limitations. This interview lasts approximately 30-60 minutes. After this conversation, the customer's training plan will be published within 1 week.

 

The length of a training session is agreed individually with the customer.

The training sessions take place in the customer's own living environment.

Private appointments are by appointment only. The agreed appointment must be canceled at least 24 hours before the agreed time. A fee of 50% of the price for a training session will be charged for missed appointments.


5 Customer Obligations


The customer is obliged to inform the coach about his physical fitness before the start of the training session without being asked. Should sudden health or ailments occur during the training or afterwards, the customer is obliged to inform the coach immediately.


6 Terms of Payment


The fee for the coach is based on the current price list.

The invoice is to be paid without deduction within 30 days of receipt by the customer.

The following payment methods are currently available: bank account transfer, Twint.

 

7 Liability and Notices


In principle, the coach is not liable for damage to the customer. This does not apply to liability for breach of an essential contractual obligation and for liability for damage to the member resulting from injury to life, limb or health, as well as for damage resulting from an intentional or grossly negligent breach of duty by the coach, his legal representatives or vicarious agents are based. Significant contractual obligations are those whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner may regularly rely. In particular, but not exclusively, the services mentioned in § 3 count as essential contractual obligations of the coach.

In the case of private training sessions with the coach, the customer is expressly advised not to bring any valuables with him. The coach does not undertake any surveillance or duty of care for any valuables brought in.

The coach is not liable for damage caused by the customer's overconfidence. If the customer does not follow the coach's instructions and suffers damage as a result, the coach's liability is excluded.

The coach has appropriate business liability insurance.


8 Privacy


The customer's personal data is stored by the coach and used exclusively to fulfill the service object specified in § 3.

When using image material on the website and social media, the customer will be asked for consent in advance. The images will not be used without permission.


9 Secrecy


The coach is obligated to maintain secrecy about all of the customer's information that has become known in connection with the fulfillment of the training measures. This also applies after the termination of the contractual relationship between the coach and the customer.


10 Contract Duration


In principle, only fixed-term contracts are concluded between the coach and the customer: 1 month, starting on the 1st of the month, unless the customer decides otherwise. The customer has the right to cancel within 14 days before the start of the new contract. If an application to terminate the contract is made within 14 days before the start of the new contract, the full amount will be charged to the customer.

Termination in between is excluded, unless there is a permanent medical indication that makes it impossible to continue the contract. Only medical certificates are accepted as proof.

 

11 Final Provisions


Changes, additions and ancillary agreements must be made in writing to be effective, unless otherwise specified in these General Terms and Conditions. The written form requirement also applies to the waiver of this form requirement.

Should one of the preceding provisions be ineffective or unenforceable, the validity of the remaining provisions shall remain unaffected. Instead of the ineffective or unenforceable provision, a suitable, legally effective replacement provision that comes as close as possible to the economic success is made by mutual agreement.

The place of jurisdiction is based on the statutory provisions. Swiss law applies.

Should a provision of these General Terms and Conditions be ineffective, this shall not affect the validity of the remaining provisions.
